WBA, established at Asselsestraat 137-2, Apeldoorn, hereinafter referred to as the “Agent”;
and
the Housing Seeker, hereinafter referred to as the “Prospective Tenant”;
Whereas:
The Prospective Tenant is seeking residential accommodation to rent;
The Agent mediates in the establishment of rental agreements between tenants and landlords of residential properties, acting exclusively on behalf of the landlord and not on behalf of the tenant, and therefore represents solely the interests of the landlord and not those of tenants;
Have agreed as follows:
Upon signing these conditions, the following rules shall apply:
By signing these conditions, the agreement between the Prospective Tenant and the Agent is confirmed. This agreement has been concluded through registration by the Prospective Tenant via the Agent’s website.
The parties confirm that, in carrying out its mediation activities, the Agent has exclusively represented and shall continue to represent the interests of the landlord.
Immediately after receipt of all required information and documents to be provided by the Prospective Tenant, the Agent shall present the Prospective Tenant to the landlord of the property.
The Prospective Tenant must also create a search profile on our website. This profile is relevant for the possible allocation of a property.
If the Prospective Tenant fails to attend a viewing appointment without cancelling the appointment well in advance, the Prospective Tenant shall be required to pay a fee to WBA. This fee amounts to €50 excl. VAT.
The Prospective Tenant is not permitted to contact the landlord directly, in any manner whatsoever, without the prior consent of WBA and without the involvement of WBA.
The membership fee amounts to €17.95 per month. Refund of the membership fee is not possible. The Prospective Tenant is responsible for cancelling the membership by sending an email to info@wba.nl or by sending a letter to WBA, established at Asselsestraat 137-2, Apeldoorn.
If you have rented a property through WBA, you may enter into a separate agreement with WBA for the performance of optional services. Acting as contractor, WBA may perform, among others, the following optional services (if applicable) for the client:
arranging energy and water connections for the rented property;
arranging cable and internet connections for the rented property;
assistance with applying for a housing permit;
assistance with applying for a parking permit;
assistance with applying for housing allowance;
acting as a point of contact for matters arising during the rental period after the conclusion of the rental agreement;
if necessary, conflict mediation by an independent mediator (maximum of 2 hours) in the event of disputes;
provision of a nameplate.
This agreement shall commence after a rental agreement has been concluded between the client and a third party/landlord through the mediation of WBA. The agreed services shall be performed by WBA as soon as possible thereafter. These services are separate from the mediation activities of WBA and are not related to the conclusion of the rental agreement.
If a rental agreement is concluded between the Prospective Tenant and a third-party landlord through the mediation of WBA, the Prospective Tenant shall owe brokerage fees to WBA, unless expressly agreed otherwise in writing.
Brokerage fees shall be charged exclusively if the property concerned is offered by a third party and not offered directly by WBA.
If the property is offered directly by WBA, no brokerage fee shall be due, unless different arrangements have been expressly agreed in writing prior to the conclusion of the rental agreement.
The brokerage fee is equal to one month’s rent excl. VAT, unless otherwise agreed. If the rent includes service charges and/or advance payments for utilities and services, the brokerage fee shall be calculated on the total monthly amount.
